Terms and Conditions

These Terms & Conditions govern membership, training services and purchases made via the Elite Force Banbury website. By becoming a member or purchasing from our shop, you agree to these terms in full.


1. Membership Fees & Payments

1.1 Membership fees are payable monthly in advance.

1.2 All membership payments are processed via Stripe using recurring automatic card payments. By subscribing, you authorise Elite Force Banbury to charge your selected payment method on a recurring monthly basis.

1.3 It is your responsibility to ensure your payment details remain valid and up to date.

1.4 If payment fails or is declined, we reserve the right to suspend or terminate your membership until payment is successfully received.


2. Cancellation & Minimum Commitment Policy

2.1 Memberships operate on a rolling monthly basis.

2.2 All Memberships are subject to a minimum commitment of one full billing month from the date of joining.

2.3 Members may cancel their membership at any time by providing written notice. Cancellation will take place at the end of the current billing period. 
– No Further payments will be taken at the end of the active billing period. 

2.4 Membership fees are non-refundable once paid.

2.5 Where a member has attended at least one training session within a billing period, that month is considered fully utilised and no refund will be issued for any unused portion.


3. Instructor Leave, Holidays & Service Availabilty

3.1 Elite Force Banbury reserves the right to take planned leave throughout the year, including but not limited to annual holidays, public holidays (including the Christmas period), and other personal commitments.

Where leave is planned, members will be provided with reasonable advance notice.

Membership fees remain payable during planned leave periods unless otherwise stated.

3.2 In the event of paternity leave, membership fees will be reduced proportionally to reflect the number of full weeks services are unavailable.

3.3 In the event of sudden illness or emergency:

  • We will attempt, where reasonably possible, to reschedule sessions.

  • At our sole discretion, a partial discount or credit may be offered.

  • We are not obliged to provide refunds for short-term or isolated cancellations.

3.4 While we aim to provide consistent and uninterrupted services, training sessions may occasionally be unavailable due to circumstances beyond our reasonable control. Temporary suspension of services does not automatically give rise to a right to refund.


4. Member Conduct

Members are expected to behave respectfully towards coaches and other members. We reserve the right to terminate membership without refund for inappropriate, abusive, or unsafe behaviour.


5. Shop Orders & Payment

5.1 The Elite Force Banbury shop sells clothing and merchandise fulfilled via Printify (third-party print-on-demand supplier).

5.2 All payments are made via card at checkout.

5.3 Orders are confirmed once payment has been successfully processed.

5.4 All products are made to order unless otherwise stated.


6. Shipping & Fulfilment

6.1 Orders are printed and shipped by our fulfilment partner (Printify).

6.2 Delivery times are estimates and not guaranteed.

6.3 Elite Force Banbury is not responsible for delays caused by shipping carriers or circumstances outside our control.


7. Returns & Refuns (Shop)

7.1 Due to the custom and made-to-order nature of our products, items are non-refundable and non-returnable, including customised items.

7.2 Refunds or replacements will only be offered if:

  • The item arrives damaged, or

  • There is a manufacturing defect.

7.3 Claims for damaged or defective items must be made within 7 days of delivery and supported with photographic evidence.


8. Liability

Participation in training is at your own risk. Elite Force Banbury is not liable for injuries sustained during training except where caused by proven negligence.


9. Assumption of Risk

Members acknowledge that participation in physical training carries inherent risks, including but not limited to injury, illness, or accidents.

By participating, members voluntarily accept and assume all such risks.

Elite Force Banbury reserves the right to suspend or terminate membership, without refund, in cases of serious or repeated misconduct, bullying, or unsafe behaviour.


10. Consumer Rights 

Nothing in these Terms & Conditions is intended to affect your statutory rights under the Consumer Rights Act 2015 or any other applicable UK consumer protection legislation.

Where services are provided, we will exercise reasonable care and skill in delivering training sessions.

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.


11. Health & Safety 

All members must follow instructions given by coaches at all times.

Members are responsible for using equipment safely and appropriately.

Elite Force Banbury reserves the right to refuse participation in any session where a member’s behaviour poses a health or safety risk to themselves or others.

Members participate in training sessions at their own risk.

Where services are provided, we will exercise reasonable care and skill in delivering training sessions.

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.


12. Medical Declaration 

By becoming a member and participating in training sessions, you confirm that:

  • You are medically fit to participate in physical training.

  • You do not suffer from any medical condition that would prevent safe participation unless disclosed in writing prior to training.

  • You will inform us immediately of any change in your health that may affect your ability to train safely.

If you are unsure about your medical suitability, you should seek advice from a qualified medical professional before participating.

We reserve the right to require medical clearance where reasonably necessary.


13. Emergency Medical Consent

In the event of illness, injury, or medical emergency during a training session, you consent to:

  • Basic first aid being administered.

  • Emergency services being contacted if deemed necessary.

Elite Force Banbury accepts no responsibility for medical costs incurred as a result of emergency treatment.


14. Limitation of Liability

 

To the fullest extent permitted by law, Elite Force Banbury shall not be liable for:

  • Any indirect or consequential loss.

  • Loss of personal belongings brought to training sessions.

  • Injuries sustained during training except where caused by proven negligence.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.


15. Photography & Media Consent

From time to time, photos or videos may be taken during training sessions for promotional purposes.

Members consent to the use of such media unless they notify us in writing that they do not wish to appear.


16. Misc. 

We shall not be liable for failure or delay in providing services where such failure is due to circumstances beyond our reasonable control.

We process personal data in accordance with our Privacy Policy as found on our website. 

All training materials, branding, logos, and content remain the intellectual property of Elite Force Banbury and may not be reproduced without permission.


17. Changes to These Terms

The Club reserves the right to update these Terms from time to time. The most current version will be available on the Club’s website. Continued participation after changes are published constitutes acceptance of the updated Terms.


18. Governing Law

These Terms are governed by the laws of England and Wales.
